1. Agreement to Terms

By creating an account or using AC3 ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use AC3.

AC3 is operated from Australia. These Terms are governed by the laws of Australia. If you have questions, contact us at support@ac3app.com.

2. Eligibility

You must be at least 16 years old to use AC3. By creating an account, you represent that you are at least 16 and have the legal capacity to enter into these Terms. If you are between 16 and 18, you represent that your parent or guardian has reviewed and consented to these Terms.

3. Your Account

You are responsible for maintaining the security of your account credentials. Do not share your login details with others. You are responsible for all activity that occurs under your account.

You agree to provide accurate information when creating your account and to keep it up to date. If you suspect unauthorised access to your account, contact us immediately at support@ac3app.com.

4. Acceptable Use

When using AC3, you agree not to:

  • Share your account credentials or allow others to access your account.
  • Use automated tools, bots, or scrapers to access or extract data from AC3.
  • Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
  • Use AC3 in a way that violates your university's academic integrity policies. You are solely responsible for ensuring your use of AC3 complies with your institution's rules.
  • Upload or transmit malicious content, viruses, or any material that could harm the Service or other users.
  • Use AC3 for any unlawful purpose or in violation of any applicable laws.
  • Resell, sublicense, or commercially redistribute any part of the Service without our written consent.

5. AI-Generated Content

AC3 uses artificial intelligence (powered by OpenAI and Anthropic) to generate study materials, summaries, practice questions, and other content. You acknowledge and agree that:

  • AI output is not guaranteed to be accurate. AI-generated content may contain errors, omissions, or inaccuracies. Always verify important information against your official course materials.
  • You are responsible for how you use AI-generated content. AC3 is a study aid, not a substitute for your own work. Submitting AI-generated content as your own work may violate your university's academic integrity policies.
  • AC3 is not a replacement for professional advice. Content generated by AC3 should not be relied upon as legal, medical, financial, or other professional advice.
  • We do not guarantee specific outcomes. Using AC3 does not guarantee improved grades or academic performance.

6. Subscriptions and Payment

Plans and Pricing

AC3 offers paid subscription plans, currently priced at $9.99 AUD per month or $49.99 AUD per semester. Prices are subject to change with reasonable notice.

Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged at the then-current rate for your plan.

Cancellation

You can cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period — you will continue to have access to paid features until then. We do not provide prorated refunds for partial billing periods.

Payment Processing

All payments are processed by Stripe. By subscribing, you agree to Stripe's terms of service.

7. Intellectual Property

Your Content

You retain ownership of any content you upload to or create with AC3, including your course notes and any materials you provide. By using AC3, you grant us a limited licence to process, store, and display your content solely to provide and improve the Service.

Our Service

AC3, including its software, design, branding, and all related intellectual property, is owned by AC3 and its licensors. These Terms do not grant you any rights to our trademarks, logos, or other brand features.

Course Materials

Course content synced from your LMS may be subject to copyright held by your university or instructors. AC3 processes this content to provide study assistance to you. You are responsible for ensuring that your use of synced materials complies with applicable copyright laws and your institution's policies.

8. Limitation of Liability

To the maximum extent permitted by Australian law, AC3 and its directors, employees, and affiliates will not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • Any loss or damage caused by reliance on AI-generated content, including but not limited to academic consequences.
  • Any loss of data, revenue, or profits, whether direct or indirect.
  • Service interruptions, downtime, or errors beyond our reasonable control.

Our total liability to you for any claims arising from or related to the Service is limited to the amount you have paid us in the 12 months preceding the claim. Nothing in these Terms excludes or limits liability that cannot be excluded under Australian Consumer Law.

9. Disclaimer of Warranties

AC3 is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

10. Termination

You may close your account at any time through your account settings or by contacting us.

We reserve the right to suspend or terminate your account if you violate these Terms, engage in abusive behaviour, or use the Service in a way that could harm AC3 or other users. Where possible, we will provide notice before taking action, unless immediate action is necessary to protect the Service or its users.

Upon termination, your right to access the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.

11. Changes to These Terms

We may modify these Terms from time to time. If we make material changes, we will notify you via email or through the AC3 app at least 14 days before the changes take effect. Your continued use of AC3 after the effective date constitutes acceptance of the updated Terms. If you disagree with the changes, you should stop using the Service and close your account.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Australia. Any disputes arising from these Terms or your use of AC3 will be subject to the exclusive jurisdiction of the courts of Australia.
